Our site offers access to both Certificate Services and Medicine Services, collectively referred to as "Services." These Services include online consultations with third-party healthcare professionals who can issue private medical certificates, third-party prescribers who can provide private prescriptions for Medicines ("Prescription"), and third-party pharmacies responsible for dispensing Medicines upon receiving a Prescription
The Terms also encompass the ownership and use of any materials, documentation, and intellectual property rights owned by us or any of our associates ("Material").
It is essential that you carefully read and understand these Terms. Prior to using the Services on our site, you will be required to agree to these Terms. If you do not agree with these Terms, you will not be permitted to access the Services on our site.
Part 1 of these Terms contains general provisions regarding your use of our site.
Additionally, if you intend to utilize healthcare professional services, prescriber services, or pharmacy services through our site, you must also read and agree to the supplementary terms and conditions presented in:

Each of these Parts is integrated into and constitutes an inseparable part of these Terms.
We, James Allen Care Ltd, are a registered company in England and Wales. Our registered office is located at 124 City Road, London, EC1V 2NX. Throughout this document, we may refer to ourselves as the "Company," "we," or "us." Our primary role is to operate the website and facilitate your access to the Services.
Through our site, we provide access to carefully chosen third-party suppliers, who we refer to as "Associates." These Associates include registered healthcare professionals ("Healthcare Professionals"), registered prescribers ("Prescribers"), and registered pharmacies ("Pharmacies"). Each of these Associates is responsible for providing specific services: certification services performed by the relevant Healthcare Professional (Part 2) and prescribing services performed by the relevant Prescriber (Part 3). Before accessing the Services on our site, it is crucial that you review and accept the additional terms and conditions outlined in these respective Parts. By offering the Services on
our site, we act as an agent for and on behalf of these Associates.
We collaborate with several Healthcare Professionals, Prescribers, and Pharmacies, who offer certification, prescribing, and dispensing services. Upon submitting your clinical questionnaire responses to our site, you will receive information about the identity, contact details, and registration of the specific Healthcare Professional, Prescriber, or Pharmacy assigned to you.
Please be aware that we cannot guarantee that you will be assigned the same Healthcare Professional, Prescriber, or Pharmacy each time you make a new enquiry about a particular Medicine. If you are dissatisfied with any of the assigned Healthcare Professionals, Prescribers, or Pharmacies, please contact us via email at hello@thegpclinic.uk
It is essential to acknowledge and agree that:
The Healthcare Professional is responsible and liable for writing and reviewing the clinical questionnaires related to accessing Certificates, conducting consultations with you, and issuing Certificates based on your questionnaire responses.
The Prescriber is responsible and liable for writing and reviewing the clinical questionnaires related to accessing Medicines, conducting consultations with you, and issuing Prescriptions based on your questionnaire responses.
The Pharmacy is responsible and liable for dispensing, checking, and delivering the Medicines to you.
The most convenient method of getting in touch with us is via email.
Our primary responsibility is to facilitate your access to the Services offered by the Associates and oversee the interaction between you and the Associates. If you need to get in touch with any of the Associates regarding the Services they have provided, please reach out to us first by email at hello@thegpclinic.uk. To help us identify you, kindly include your order number or account details.
When these Terms refer to communication in writing, it encompasses any communication sent by us or any Associate through on-screen messages, notifications, prompts, or any other form of communication or information provided to you via our site or through email using an email address you have provided to us. However, this clause does not apply to the requirements of serving any documents in legal proceedings
4. Communication and Security
By accepting these Terms, you are giving your consent to communicate with us electronically, and you are considered to agree to receive electronic
communications from us or our Associates. Electronic communications may include emails, notifications, alerts, disclosures, and information provided via our site, among other means. You acknowledge that any electronic communication sent to you by us fulfils any legal requirement that such communication should be in writing.
If you receive a user identification code, password, or any other confidential information as part of our security procedures, you must keep it confidential and

Share relevant information with your GP or other regular healthcare providers,
and/or
Prevent fraud and other relevant criminal activities.
To verify your identity, we employ various identity verification services that check your details against multiple sources. By accepting these Terms, you grant us permission to conduct such verification checks. If, for any reason, we are unable to verify your identity through these checks, we will contact you to request further evidence of your identity.
You also consent to the exchange of information about yourself, your health, and your current medications, including the information provided during online consultations and clinical assessments, between us, our employees, and Associates. This exchange of information is essential for the purpose of providing you with Medicines, Certificates, and/or Services.
6. Changes to These Terms or Our Site
These Terms are subject to occasional amendments.
Before using our site, we recommend reviewing these Terms each time to ensure you understand the current terms and conditions.
We may make revisions to these Terms under the following circumstances:
1. Changes in relevant laws and regulatory requirements, or
2. When we, at our absolute discretion, consider it necessary or beneficial to do so.
In the event that we revise these Terms, we will make an effort (but not obligated) to notify you of the changes.
Additionally, our site may be updated and modified from time to time to accommodate changes in Medicines, Certificates, Services, user needs, and/or our business priorities.
7. Linking
The links to third-party websites found on our site are provided solely for your convenience. By using these links, you will be redirected away from our site.Please note that we have not reviewed these third-party websites, and we do not have control over their content or availability. As a result, we are not responsible for them, and we do not endorse or make any representations regarding their content, materials found there, or any outcomes that may result from using them. If you choose to access any of these third-party websites
linked to our site, you do so entirely at your own risk.
You are allowed to link to our home page, provided that you do so in a manner that is fair, legal, and does not harm our reputation or take advantage of it.
You must not create a link that implies any form of association, approval, or endorsement from us when no such relationship exists.
Links to our site should not be established on any website that is not owned by you.
It is not permitted to frame our site within another website, and you may only create a link to our home page, not to any other part of our site.

8. Cancellation by You
You have the option to cancel a Service by providing us with written notice in the following situations:
1. If we substantially violate these Terms and fail to rectify the breach within 14 days after receiving written notice from you about the breach.
2. If our performance is hindered by an "Event Beyond Our Control," as described in clause 25.
3. If we undergo liquidation or if a receiver or administrator is appointed over our assets.
4. You can cancel a Service at any time before the relevant Service commences.
Your right to cancel a Certificate or Certificate Service ends on the date when the Certificate is issued, which is the point at which a contract between us is formed.
Similarly, your right to cancel a Medicine or Medicine Service ends on the date of the dispatch confirmation, which is when the contract between us is established.
9. Refunds for Certificates - Limitations
We hope that you will be satisfied with any product you order from our website.
However, please note the following cancellation and refund policies for Certificate orders:
To cancel a Certificate order, you must get in touch with us before the Certificate is issued. In such cases, we will provide a full refund of the product price and applicable delivery charges.
If you contact us after a Certificate has already been issued, you will not be eligible for a refund, regardless of the circumstances.
To cancel your medical certificate, please contact our customer service team at hello@thegpclinic.uk.
Please be aware of the following scenarios where a refund will not be granted:
If we have sent an email, text, or any other form of electronic communication with a download link for a digital copy of your Certificate to the email address or other contact information provided during your order.
If the Certificate is no longer required or necessary after it has been issued.
If the Certificate is not accepted by your employer, educational institution, airline, insurance provider, or any other party. We recommend that you review local laws and guidance regarding the fit note applicable to you before placing an order. It's also advisable to contact the relevant party to verify if they will accept the medical statements or advice provided by Healthcare Professionals regarding your health and fitness.
If the delay in your order is due to customer error, such as providing incorrect contact information.
Refunds will be processed using the original payment method. In the event that the card used for payment has expired, please contact us via email to provide updated card details.
You will not be eligible for a refund in the following situations:
1. The unavailability of any Associate when our site is operational, but an alternative Associate is available.
2. Temporary interruptions in the Service.
3. Any interruptions in the Service not caused by us.
By accepting these Terms, you understand that Healthcare Professionals may have varying clinical opinions, and as long as a consultation and/or online clinical assessment are conducted in good faith by a Healthcare Professional, you will not be entitled to a refund for any Service provided.
Furthermore, you will not be eligible for a refund if the provision of the Service is restricted due to:
1. Your absence.
2. Insufficient or inconsistent network connectivity.
3. Your negligent act or omission.
4. No fault on our part.
10. Refunds for Medicines - Limitations
We hope that you will be satisfied with any product you order from our website.
However, if you wish to return a Medicine for any of the following reasons:
1. It is not as described,
2. It is not fit for its intended purpose, or
3. It is damaged or faulty,
You must contact us within 30 days of receiving your order. In such cases, we will provide a full refund of the product price, applicable delivery charges, and any reasonable costs incurred in returning the item. If you contact us after the 30-day period, you will not be eligible for a refund.
To initiate a return for your medication, please get in touch with our customer service team at hello@thegpclinic.uk to discuss your order and the return process. If you return your order at your expense without notifying our customer service team beforehand, we will be unable to process your refund.
Please be aware that our associates may use third-party delivery services to fulfil orders. If the tracking GPS from the assigned delivery service confirms that your order was delivered to the correct area of the delivery location, you will not be entitled to a refund or replacement.
If the third-party delivery service has your signed signature as proof of delivery, you will not be entitled to a refund.
However, if your order is not received due to an admitted error with the third-party delivery service, you are entitled to a refund.
You will not be eligible for a refund if your diagnosis changes, making your order no longer necessary or required.
Please note that all Medicines are not brand-specific unless specifically stated in the title or description. Images used are for illustrative purposes only and may not represent the exact brand you receive. Therefore, you will not be entitled to a refund if you receive an undesired brand or if you select an incorrect medication, such as choosing a generic medication when a branded version is required, or vice versa.
If your order does not yield the desired results, you are not entitled to a refund.
We recommend contacting your GP for a review and discussion regarding the medication's effectiveness.
You will not be entitled to a refund if your order was delayed due to customer error, such as providing an incorrect address.
If you are not present to accept your parcel during attempted delivery and fail to arrange a redelivery or collection, you will not be entitled to a refund for shipping costs.
If you choose to return your order to us within 14 days of delivery, you have the option to request a resend of the item instead of a refund.
Refunds will be processed using the original payment method. In the event that the card used for payment expires before the refund is processed, please contact us to provide your updated card details.
Please be informed that you will not be entitled to a refund under the following circumstances:
The unavailability of any Associate while our site is functional, and an alternative Associate is available.
Temporary interruptions in the Service.
Any interruptions in the Service not caused by us.
By accepting these Terms, you acknowledge that Prescribers may have differing clinical opinions, and as long as a consultation and/or an online clinical assessment is conducted in good faith by a Prescriber, you will not be eligible for any refund for the Service provided.
You will not be entitled to a refund for any Service if the provision is restricted due to:
1. Your absence.
2. Insufficient or inconsistent network connectivity.
3. Your negligent act or omission.
4. No fault on our part.
Lastly, please be aware that, for safety reasons, you cannot return any Medicines other than as specified in these Terms. If you have unwanted or unused medication, you can take it to a local pharmacy for proper disposal.
11. Missing Medicine Items
If you suspect that some items are missing from your Medicines order, please inform our customer service team within 14 days of the delivery date. If you reach out to us after the 14-day period, we will not be able to offer a refund or resend of the missing items.
For cases where only some items are missing, we will need a photo of the dispensing label on the box of the received items. This photo is required for further investigation with the pharmacy. Failing to provide the requested photo of the dispensing label will hinder our customer service team from proceeding with the claim with the pharmacy.
Once you have notified our customer service team about the missing item(s), a representative will provide you with a Missing Items Form. It is essential that you complete this form and return it to us. Failure to do so will prevent our customer service team from providing further assistance regarding the missing items.
12. Cancellation by Us
There might be occasions where we need to cancel a Service before it commences due to the following reasons:
An Event Beyond Our Control, as defined in clause 23, or The unavailability of any Associate or Material, which is essential for providing the Service.
If a Service becomes unavailable as per clause 2, we will notify you in writing as soon as reasonably possible.
In the event of cancelling a Service according to clause 2 and you have already prepaid for a Certificate or Certificate Service that has not been provided yet, we will issue a full refund.
Similarly, if we cancel a Service according to clause 2 and you have already prepaid for a Medicine or Medicine Service that has not been provided yet, we will also issue a full refund.
We reserve the right to immediately cancel a Service request by providing written notice if:
You fail to make a required payment, or You breach these Terms, and you do not rectify the breach within 7 days of our written request or sooner, if reasonably required.
Occasionally, we may request confidential information from you that may be covered by data protection legislation, such as details about medical conditions.
If you do not provide this information or provide incomplete, misleading, or incorrect information, we may suspend the Services or the supply of Certificate or Medicine by providing written notice. In such circumstances, we will not be liable for any delay or non-performance resulting from your failure to provide this information, and we will not be obligated to provide a refund.
13. Unacceptable Use
We have the authority to decline access to our site or discontinue a Service, which may involve deleting your account and information, with immediate notice if you substantially violate these Terms and other relevant terms and conditions or if you engage in inappropriate or abusive conduct towards any Associate, our employees, or agents.
Such conduct may include:
• Using foul language, making threats, displaying inappropriate, abusive, or offensive behaviour, or making inappropriate remarks;
• Engaging in actions deemed as time-wasting; or
• Excessively using the Services or excessively purchasing Certificates or Medicines, as judged in our reasonable opinion.
14. Suspension or Withdrawal of Our Site
Our site is offered at no cost, and we cannot guarantee its continuous availability or uninterrupted access. There may be times when we need to suspend, withdraw, or limit access to all or certain parts of our site due to business or operational reasons. While we will make efforts to provide reasonable notice of any such actions, we are not obligated to do so.
It is your responsibility to ensure that all individuals accessing our site through your internet connection are aware of these Terms and other relevant terms and conditions, including those specified in Parts 2 and 3 of these Terms, and that they adhere to them.
15. Delivery of Certificates
The download link for Certificates will be sent directly to the contact information you provided for receiving your order through email or any other appropriate electronic means.
In situations where you need to present the original wet-ink signed Certificate to an interested party, such as when obtaining visas, we will deliver it to the address of your choice. Any applicable delivery costs will be communicated to you when you express your intention to purchase such a Certificate, along with the expected date and time of delivery.
The price for Certificates will be based on a per-item issuance rate as stated on our site at the time of issuance.
16. Delivery of Medicines
Medicines will be delivered to the address you select. We will notify you of any associated delivery costs when you express your intention to purchase a Medicine, along with the expected date and time of delivery.
The price for Medicines will be based on a per-item prescription rate as stated on our site at the time of dispensing.
17. Display and Availability of Medicines
Although we strive to keep the information on our site, including descriptions of Medicines and Medicine Services, up to date, we cannot guarantee that the content is entirely accurate, complete, or current. We provide no representations, warranties, or guarantees, whether explicit or implied, regarding the accuracy of the information on our site.
Please note that the images displayed on our site are for illustrative purposes only. There may be variations between the images and the actual Medicines, and we do not take responsibility for any reliance placed on the accuracy of these images. Additionally, the packaging for the Medicines may differ from the images shown on our site.
All Medicines presented on our site are subject to availability. During a consultation with a Prescriber, if you express a preference for a specific treatment or a prior successful treatment for your condition, you and the Prescriber will collaborate in considering the appropriate course of action.
However, it is essential to understand and agree that the final decision on the Medicine prescribed to you will always rest with the Prescriber.
18. Pricing of Certificates and Certificate Services
The costs for Certificates and Certificate Services will be as displayed on our website, encompassing the fees owed to the Healthcare Professional.
Prices for Certificates or Certificate Services may undergo occasional modifications, but any changes will not impact the cost of Certificates issued for you during a consultation.
The price of a Certificate or Certificate Service includes Value Added Tax (VAT), if applicable, at the prevailing rate charged in the UK.
The price of a Certificate may not incorporate delivery charges, if applicable. In such cases, the delivery costs will be clearly indicated on our website before you proceed with your Certificate request.
19. Pricing of Medicines and Medicine Services
The prices of Medicines and Medicine Services, including the fees for the Prescriber and Pharmacy, are as displayed on our website. We take reasonable measures to ensure the accuracy of these prices when the relevant information is entered on our site.
Please note that prices for Medicines or Medicine Services may undergo periodic changes, but any such modifications will not affect the cost of Medicines prescribed for you during a consultation.
The price of a Medicine or Medicine Service incorporates Value Added Tax (VAT), where applicable, at the prevailing rate charged in the UK.
In some cases, the price of a Medicine may not include delivery charges. If applicable, these charges will be clearly stated on our website before you proceed with your request for a Medicine.
Our website features a wide range of Medicines. While we make every effort to maintain accurate pricing, there might be instances where some Medicines are incorrectly priced. As part of our dispatch procedures, we typically verify the prices. In such situations:
If the correct price of the Medicine is lower than the price indicated on our site, we will charge you the lower amount when providing the Medicine. However, if the pricing error is obvious and unmistakable, and it could have been reasonably recognized by you as a mispricing, we are not obliged to provide the Medicine at the incorrect (lower) price.
If the correct price of the Medicine is higher than the price stated on our site, we will promptly notify you of this error and present you with the option to proceed with the purchase at the correct price or cancel the purchase. We will not process your request until we have received your instructions.
20. Payments and Charges
Upon being issued a Certificate or a Prescription, you are required to make full payment for all Certificates, Medicines, Services, and any applicable delivery fees at the time of confirming your purchase. By utilising our website, you recognize that we act as an agent representing the Associates and possess the authorization to enter into contracts for providing Services, selling, issuing, and delivering Certificates, selling and delivering Medicines, as well as collecting payments on their behalf.
21. Payment Methods
You have the option to make payments via the third party application available on our site, accepting electronic bank transfer, debit or credit card. It is essential that you provide accurate and valid payment information. In the event that your payment details are expired or deemed invalid, we reserve the right to withhold the issuance of Certificates, Medicines, or Services. Should such a situation arise, we will make an effort to contact you in order to request updated payment information.
22. Continuous Authority
Payments are established on a 'continuous authority' basis, enabling the possibility of additional payments or refunds to be processed on your payment card, if necessary.
23. Verification Checks
In order to prevent unauthorized use of your payment method, we will conduct verification checks on your name, address, and other personal information using third-party databases. By accepting these Terms, you give your consent to
these checks. During the verification process, the information you provided during registration may be shared with a registered credit reference agency, which will retain a record of this information. Please note that this verification process is solely for confirming your identity and will not have any impact on your credit rating. Rest assured that all the information you provide will be handled securely and in strict accordance with relevant data protection laws.
24. Our Liability to You
We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, subcontractors or Associates, and for fraud or fraudulent misrepresentation.
We will not be liable for any loss of profit or any indirect or consequential loss arising from or in connection with any Certificate, Medicine or Service. Subject to clause 2, our total liability to you arising from or in connection with any
Certificate, Medicine or Service will be limited to the amount you paid for the Certificate, Medicine or Service.
Our website is not designed or suitable for treating or managing medical emergencies, acute conditions, or any condition requiring in-person analysis, diagnosis, or urgent treatment. We will take appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing and accidental loss, destruction, or damage. However, subject to our legal obligations as a data controller, we are not responsible for
data loss or unauthorised access by others, whether due to unauthorised access, misaddress, technical failure, technical interference, negligence, or any other cause.
We disclaim all warranties, expressed or implied (to the extent permitted by law), including but not limited to implied warranties of satisfactory quality and fitness for a particular purpose. We do not warrant that our site or any notifications sent to you will be free of viruses or other harmful components.
We do not accept any liability or responsibility for the actions or omissions of any third party, including Associates. We only facilitate access to Certificates, Medicines and Services for your personal use. You agree not to use the
Certificates, Medicines or Services for commercial, business, or resale purposes, and we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity if you use the Certificates, Medicines or Services contrary to these Terms.
We are not liable for any loss or damage resulting from your use of any Certificate, Medicine or receipt of any Service if you provide incorrect, misleading, or incomplete information. We are not liable for any loss or damage arising from your failure to inform your GP or other healthcare professionals about any Certificates, Medicines or Services requested from our site. We are not liable for any loss or damage resulting from your failure to follow advice given on our site.
Please note that the advice given on our website is not intended to replace consultations with your GP or other healthcare professionals. You should consult them about any medical letters, medications or services you obtain through our website.
25. Limitation of Liability for Events Beyond Our Control
We shall not be held responsible for any failure to fulfil our obligations under these Terms if it is caused by an "Event Beyond Our Control". Such events include acts or occurrences beyond our reasonable control, such as strikes,
lockouts, industrial actions by third parties, civil unrest, riots, invasions, terrorism or threats of terrorism, war or threats of war, fires, explosions, storms, floods, earthquakes, subsidence, epidemics, pandemics, or other natural disasters, as well as failures in public or private telecommunications networks.
If an "Event Beyond Our Control" significantly affects our ability to fulfil our obligations under these Terms, we will promptly notify you, and our obligations will be suspended while the event persists. The time for performance will be
extended for the duration of the event. In cases where the event affects the supply of a wet-ink signed medical letter or medication to you, we will coordinate a new collection or delivery date with you once the event has concluded.
You have the right to cancel a service if an "Event Beyond Our Control" continues for at least 7 (seven) days. To exercise this right and cancel a service, you must provide written notice, subject to clause 8. Additionally, we may also
cancel a service if an "Event Beyond Our Control" persists for at least 28 (twenty-eight) days.
26. Your Responsibilities
By agreeing to these Terms, you acknowledge that providing false, inaccurate, incomplete, or misleading information during your use of our site or interactions with a Healthcare Professional or Prescriber may lead to the issuance of a
medical certificate or prescription based on incorrect information, which could result in serious or even life-threatening consequences. You agree not to engage in such practices and understand that doing so constitutes a breach of
these Terms.
Upon accepting these Terms, you commit to the following:
• Providing accurate and complete information to us and our Associates;
• Promptly notifying us, the Healthcare Professional, Prescriber, or the Pharmacy of any inaccuracies or omissions in your medical records, test results, or prescriptions;
• Adhering to all instructions, advice, and treatments provided by the Healthcare Professional, Prescriber, or the Pharmacy;
• Informing your regular GP or other healthcare providers about any medications and advice received through our site;
• Seeking additional independent medical opinions from other healthcare providers and utilizing emergency services as necessary if you have any doubts or concerns about the information, advice, or instructions received through our
site or related to your health or any conditions;
• Complying with any instructions given by the Healthcare Professional, Prescriber, or the Pharmacy regarding medication usage, including route, timing, and dosage;
• Reporting any medication side effects as soon as reasonably possible;
• Not registering or attempting to register on behalf of someone else, providing information in response to an online clinical assessment on behalf of someone else, or impersonating another individual;
• Not registering or attempting to register multiple accounts on our site. Creating multiple accounts may result in the disabling of one or all accounts.
27. Intellectual Property
All the content available on our site, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is safeguarded by copyright, trademarks, database rights, and other intellectual property rights. You agree not to tamper with any copyright or proprietary notices on our site and acknowledge that you will not gain ownership of any copyright or other intellectual property rights in any materials or content provided through our site. We disclaim any responsibility for any consequences arising from your use of our site from locations outside the United Kingdom.
30. Dispute Resolution
Any dispute or claim that arises under these Terms must be notified to us in writing within 14 (fourteen) days of the dispute or claim arising. The written notice should include comprehensive details about the dispute or claim. Failure to provide written notice within the specified time limit will prevent you from making such a claim.
In the event of a dispute, both parties agree to seek resolution. If the dispute cannot be resolved within 60 (sixty) days from the initial notification, both parties agree to attempt to settle it through mediation following the Centre for Effective Dispute Resolution Model ("CEDR") Mediation Procedure. Unless otherwise agreed between the parties, CEDR will select the mediator. To initiate the mediation process, either party must provide written notice ("ADR Notice")
requesting mediation and send a copy to CEDR. The mediation will commence no earlier than 60 (sixty) days from the date the ADR written notice is provided. Both parties irrevocably agree that neither may initiate court proceedings
concerning any dispute arising from matters related to these Terms until mediation has been attempted, and either the mediation has concluded, or the other party has failed to participate in the mediation for a period of at least 30 (thirty) days from the start of the mediation.
31. Additional Terms
Each clause in these Terms operates independently. If any court or relevant authority determines that any clause or subclause is unlawful or unenforceable, the remaining clauses and subclauses will remain in full force and effect.
Our failure to insist on the performance of any of your obligations under these Terms, to enforce our rights against you, or to delay in doing so, does not waive our rights against you, nor does it relieve you of the responsibility to comply with those obligations. If we waive a default by you, we will do so in writing, and it does not imply an automatic waiver of any future defaults by you.
These Terms are governed by English law. This means that any dispute or claim arising from or in connection with these Terms will be governed by English law.
By accepting these Terms, you irrevocably agree that the courts of England will have exclusive jurisdiction.
32. Consumer Rights
Consumers have legal rights concerning faulty or misdescribed Certificates, Medicines, and/or Services. For guidance on your legal rights, you can seek advice from your local Citizens' Advice Bureau or Trading Standards Office.
These Terms do not impact your statutory rights.
The provision of Services will be subject to the additional terms and conditions of the Associate, outlined in Parts 2 and 3 of these Terms.
33. Complaints

For complaints related to the prescribing of your Certificates, we will forward them to the appropriate Healthcare Provider, as notified to you in accordance with clause 5.
For complaints related to the prescribing of your Medicines, we will forward them to the relevant Prescriber, as notified to you in accordance with clause 5.
For complaints related to the dispensing of your Medicines, we will forward them to the relevant Pharmacy, as notified to you in accordance with clause 5.
The Healthcare Professional Services offered on our site will be provided by various Healthcare Professionals, and each time you access the site, you will be informed and identified regarding the specific Healthcare Professional handling your request, in accordance with clause 2 of Part 1 of these Terms. It is important to understand that each Healthcare Professional is bound by the terms and conditions outlined in Part 2 of these Terms.
By accessing and using the Healthcare Professional Services, you confirm that you comprehend and accept the additional terms and conditions specified in Part 2 of these Terms, and you agree to be legally bound by them.
If you do not agree to the additional terms and conditions stated in Part 2 of these Terms, you are not permitted to access or use the Healthcare Professional Services.
In case you agree to the additional terms and conditions presented in Part 2 of these Terms, please take note of clause 8 below (Limitation of Liability).
2. Professional Standards
Prescriber Services encompass a thorough process that includes reviewing clinical questionnaires, conducting consultations, and issuing medical certificates and fit notes. To ensure the provision of high-quality care, Healthcare Professionals may also follow up with certain patients as part of the service. These Healthcare Professional Services are rendered by registered and eligible Healthcare Professionals who are authorised to issue Certificates without the need for face-to-face interactions. Rest assured that all Healthcare Professionals strictly adhere to the guidelines set forth by their respective regulatory bodies regarding the remote issuance of fit notes.
3. Account Creation
By registering an account to access the Healthcare Professional Services, you confirm the following:
1. The information you provide during the registration process is accurate and complete.
2. You will maintain the confidentiality of your username and password and take reasonable precautions to prevent sharing your login credentials with others
3. You affirm that you are 18 years of age or older.
4. Our Responsibilities
We are committed to the following principles when providing the Healthcare Professional Services:
1. We will assume professional accountability for each patient using the Healthcare Professional Services, treating the consultations with the same level of responsibility and care as if they were conducted in person.
2. Our services will be provided in a professional and transparent manner, adhering to the guidelines outlined by the relevant regulatory body for issuing fit notes remotely and following clinical best practices.
3. When issuing fit notes and communicating with patients, we will disclose the name and professional registration number of the Healthcare Professional involved in the process.
4. Fit notes will only be issued when, based on our professional judgement, it is in the patient's best interest. We will refrain from issuing a fit note if we believe it is not in the patient's best interest without conducting a face-to-face
consultation.
5. We will take reasonable precautions to safeguard patients' personal information, as described in Part 1 of these Terms and in accordance with the Privacy Policy.
5. Your Obligations as a Patient
As a patient, you agree to abide by the following terms:
1. You will provide honest, accurate, and complete responses to all questions during clinical questionnaires and consultations.
2. You will not create multiple accounts on the site.
3. You will not register or complete clinical questionnaires or consultations on behalf of anyone else but yourself.
4. You will accept our decision if we determine that a face-to-face consultation is necessary for your best interests.
5. You will inform your GP about your medical letter order. While we may offer to notify your GP about fit notes issued, if you decline, it is your responsibility to inform them. In emergencies, we may need to contact your GP, other
healthcare professionals, social services, or emergency services without your consent, even if you have declined our offers to contact your GP.
6. Information and Guidance
The advice and recommendations given during the Healthcare Professional Service are derived from the details you provide in the clinical questionnaire and consultations. It is your duty to verify the accuracy and completeness of this
information. You understand that any inaccuracies, whether deliberate or unintentional, may impact the advice and guidance we offer and the certificates issued, and we shall not be held responsible for any resulting consequences.
7. Medicine Authorisation
We can assess whether issuing a certificate is in your best interests only when we have all the necessary and relevant information. In some cases, this may necessitate requesting additional details beyond what you initially provided in
the clinical questionnaire or during a consultation.
8. Limitation of Liability
As the Healthcare Professional, we assume complete clinical responsibility for all patients utilizing the Healthcare Professional Services to the extent mandated by the law.
We shall not be held liable for any loss or damage (whether in contract, negligence, or any other legal basis) under the following circumstances:
1. There is no violation of a legal duty of care owed to you by us.
2. The loss or damage is not a reasonably foreseeable consequence of any such violation.
3. Any loss, damage, or increased risk of loss or damage results under the mentioned circumstances.
Prescriber Services will be provided by one of several Prescribers, and each Prescriber's identity will be disclosed to you whenever you access the site in accordance with clause 2 of Part 1 of these Terms. Each Prescriber is legally bound by the terms and conditions stated in Part 3 of these Terms.
By accessing the Prescriber Services, you confirm your understanding and agreement to be bound by the additional terms and conditions specified in Part 3 of these Terms. If you do not agree to these additional terms and conditions, you are not permitted to access the Prescriber Services.
In case you agree to the additional terms and conditions outlined in Part 3 of these Terms, please take note of clause 8 below regarding Limitation of Liability.
2. Professional Standards
Prescriber Services encompass the review of clinical questionnaires, conducting consultations, and issuing Prescriptions. Our prescribers ensure the delivery of quality care by also following up with some patients. These services are provided by qualified prescribers who have the authority to prescribe Medicines and issue Prescriptions without conducting face-to-face meetings with patients.
All our prescribers adhere to the guidelines set forth by their respective regulatory bodies concerning remote prescribing.
3. Account Creation
Upon creating an account to access the Prescriber Services, you confirm the accuracy and completeness of the information you submit. You also agree to uphold the confidentiality of your username and password, ensuring that you take reasonable measures to prevent sharing your login details with others.
Additionally, you confirm that you are 18 years of age or older.
4. Our Responsibilities
We pledge to uphold the following commitments regarding the Prescriber Services:
• Assuming full professional responsibility for each patient using the Prescriber Services, treating the consultation as if it were conducted in person.
• Providing a professional and transparent service in accordance with the guidelines specified by the relevant regulatory body for remote prescribing and adhering to clinical best practices.
• Disclosing the name and professional registration number of the Prescriber when issuing prescriptions, prescribing medicines, and communicating with patients.
• Prescribing medicines only when, based on our professional judgment, it is in the patient's best interest, and refraining from issuing a prescription if we believe it is not in the patient's best interest without a face-to-face consultation.
• Implementing reasonable precautions to safeguard patients' personal information, as outlined in Part 1 of these Terms and the Privacy Policy.
5. Your Obligations as a Patient
As a patient, you agree to the following terms:
• Provide truthful, accurate, and complete responses to all questions.
• Not create more than one account on the site.
• Not register or complete clinical questionnaires or consultations on behalf ofanyone other than yourself.
• Follow any instructions given for each medicine, and if uncertain about any instructions, contact the site for clarification before using the medicine.
• Accept our decision when we determine that a face-to-face consultation is necessary for your best interests.
• Inform your GP about your medicine purchase. While we may offer to notify your GP about prescribed medicines, if you decline, it is your responsibility to inform them. In emergencies, we may need to contact your GP, other healthcare professionals, social services, or emergency services without your consent, even if you have declined our offers to contact your GP.
• Ensure that only you have access to your prescribed medicines.
• Confirm that medicines are not used past their expiry date.
• Notify us through the site if you experience any side effects or believe any medicine has been ineffective.
6. Information and Guidance
The information and guidance we provide during the Prescriber Service is based on the information you submit in the clinical questionnaire and during consultations. It is your responsibility to ensure this information is correct and complete. You acknowledge that failing to do so, intentionally or otherwise, may affect the information and guidance we provide, the medicines we prescribe, and may result in consequences for which we are not liable.
7. Medicine Authorisation
The information and advice we offer through the Prescriber Service are reliant on the details you provide in the clinical questionnaire and during consultations.
It is your responsibility to ensure that this information is accurate and complete.
You understand that any inaccuracies, whether intentional or unintentional, may impact the guidance we provide and the medicines we prescribe. As a result, we shall not be held liable for any consequences arising from such inaccuracies.
8. Limitation of Liability
As the Prescriber, we fully assume clinical responsibility for all patients utilizing the Prescriber Services, as required by applicable law.
We shall not be held liable for any loss or damage (including cases of contract, negligence, or otherwise) under the following circumstances:
1. When there is no breach of any legal duty of care owed to you by us.
2. When the loss or damage is not a reasonably foreseeable outcome of such a breach.
3. When any loss or damage, or an increased risk thereof, arises for reasons beyond our control.
